Under the 90-day rule, what are applicants not allowed to do in the United States? +
The most recent entry into the United States on a nonimmigrant visa other than an H or L visa should, for at least 90 days after entry, avoid engaging in any conduct that could be construed as indicating “an intent to reside permanently upon entry.” Such conduct includes purchasing real estate, applying for a driver’s license, obtaining long-term health insurance, and similar activities, as well as any actions that violate the terms of the nonimmigrant visa used for entry.
What is the impact of departing without an I-131 (reentry permit) on an I-485? +
Generally speaking, applicants who have filed an I-485 application may not leave the United States while their I-485 is pending. Unless the applicant holds a valid H visa or L visa status, leaving the country during the I-485 processing period will be considered a waiver of the application, resulting in the I-485 being denied. However, if the applicant has applied for and been approved for an “Advance Parole” travel document, they may safely depart the United States and return within the validity period of that document without being deemed to have waived their I-485 application.

Can the applicant skip the visa backlog by first obtaining another passport? +
Under the default rules, immigrants are “counted” in visa queues based on their country of birth. However, if an immigrant’s spouse was born in another country, the principal applicant can request that the visa queue be calculated according to the spouse’s country of birth. This is known as cross-chargeability and is often very helpful in shortening visa wait times. If the spouse’s country of birth does not experience visa backlogs, the principal applicant from a backlog country may qualify for an immigrant visa immediately without having to wait in line at all.
What steps will be involved in applying for a visa at the National Visa Center (NVC)? +
The first step in the NVC process is to ensure that all family members have been added to the case and that the corresponding visa processing fees have been paid. The second step is to submit a DS-260 immigrant visa application for each family member. The third step is to submit personal documentation (known as civil documents) for each family member.
